Terms Of Service
Outhouse Design insist in written confirmation (by post or email) before commencment of any agreed work..
We reserve the right to ask for a 50% deposit prior to a job commencing. This is usually applicable to larger projects although not exclusively.
For projects that include the buying in of external print services, and unless otherwise stated, we charge a markup cost. This is standard practice for design agencies and covers administration, print preparation and any additional risk involved.
We do also offer a service where we can source print and other prices, and the client pays the printers or other supplier directly for their service. Some suppliers will ask for the full amount payable before the products or services are released, but Outhouse Design would only charge an administration cost for sourcing these prices.
Outhouse Design provide hosting and email services via a reseller package with Heart Internet - We charge £50 per annum for hosting with emails ( if databases are required this will be at an agreed price)
If we supply a client with passwords or FTP information, it is solely the clients responsibility to keep this information safe and secure. Outhouse Design does not accept responsibility for instances where servers or information databases have been compromised from loss or distribution of sensitive passwords and other information.
Copyright legislation (Copyright, Designs and Patents Act 1988) states that the individual or collective that authored the work will normally be the exclusive owner of the work unless otherwise stipulated. The relevant sections can be found at www.legislation.gov.uk and read as follows:
11 First ownership of copyright.
(1) The author of a work is the first owner of any copyright in it.
16 The acts restricted by copyright in a work.
(1) The owner of the copyright in a work has the exclusive right to do the following acts in the United Kingdom:
(a) to copy the work;
(b) to issue copies of the work to the public;
(ba) to rent or lend the work to the public;
(c) to perform, show or play the work in public;
(d) to communicate the work to the public;
(e) to make an adaptation of the work or do any of the above in relation to an adaptation
As outlined above, all work created by Outhouse Design remains our copyright unless otherwise stipulated below or by seperate contract.
Logos and Branding:
Once Outhouse Design has received payment in full, final published artwork becomes the property of the client for the original intended use only (for the purpose the logo was originally intended for). Subsequent uses or applications other than those originally stipulated without approval of Outhouse Design is an infringement of copyright. Altering/adapting the logo for use elsewhere by the client or a third party is an infringement of copyright. Unlimited copyright of the logo is available upon request and for a small fee. This would allow the client to use/alter the logo without limitation, while Outhouse Design would reserve the right to use the logo in a promotional capacity on websites and in printed form.
Once Outhouse Design has received payment in full, final published artwork becomes the property of the client for the original intended use only (for the purpose the artwork was originally intended for), excluding fonts and other elements such as stock images that may have been sourced from a third party, the license for which will remain in the ownership of Outhouse Design. Should the client wish to use such licensed elements for subsequent applications they must arrange their own license agreements with the original seller/creator. Outhouse Design retains the right to publish all artwork as its own, unless specifically released in writing and after all costs have been settled. Outhouse Design retains the right to use all designs for promotional material and for tenders for new work, regardless of who owns copyright.
Development stages of any logo, branding, graphic design or artwork remain the property of Outhouse Design after the completion of the project. The client will only ever own copyright to the final published artwork. Any designs not used as a final solution in fulfilling the original brief remain the property of Outhouse Design, unless agreed in writing that this arrangement has been changed.
Any design work that is subsequently used after termination of the contract is a breach of copyright, for which the client will be held liable.
The client is liable for any copyright breaches on any content provided by the client to Outhouse Design. Outhouse Design retains no rights to any concepts or content provided by the client, subsequently Outhouse Design does not retain the right to re-create, resell or distribute any business concepts, text content or images provided by the client.
The client is not permitted to resell or make profit from selling design work created by Outhouse Design. (If you wish to resell work, please submit a request for a Resellers Contract. Please note this will affect the quote.)
Outhouse Design will never knowingly copy another designer's or agency's work. The contents of this site or any other site related to Outhouse Design, including blogs and social media site pages (content being images, text, sound and video files, programs and scripts) is copyright © Outhouse Design. All rights are expressly reserved.
Use of content
The content of this website can be accessed, printed and downloaded in an unaltered form (unaltered including being stretched, compressed, coloured or altered in any way so as to distort content from its original proportions or format) with copyright acknowledged, on a temporary basis for personal study which is not for a direct or indirect commercial use and any non-commercial use.
You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from Outhouse Design, without the prior written consent of Outhouse Design.
Third party material
We always recommend that clients use professional photography and copywriting for projects. Both of these services are offered by Outhouse Design. We will not accept responsibility for errors within the copy provided by a third party. Alternatively, we are happy to recommend certain suppliers or professionals that we already have working relationships with.
Changes to these Terms Of Service
Outhouse Design reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service, as well as any other changes to the current Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
